The Director, Corporate Counsel – Market Access Legal will provide proactive, efficient, and collaborative legal support for Regeneron’s Market Access Commercial Business Unit and provide legal advice to a wide range of internal clients, including Market Access Strategy, Government Pricing, Contract Strategy, Operations, and Pricing as well as Commercial, Marketing, Sales, Public Policy and Government Affairs, Regulatory, and Corporate Compliance. The level of counseling requires a deep understanding of market access, market access strategy, pharmaceutical distribution channels, contract drafting, contract operations, government pricing functions, regulatory and compliance issues, the False Claims Act, the Anti-Kickback Statute, and OIG guidance, and other applicable state and federal healthcare laws. The ideal candidate will have relevant in-house experience providing practical and strategic legal advice on a broad range of issues.
This role is based at Regeneron's offices in Sleepy Hollow, NY (4 days a week onsite) - it is not open to hybrid or fully remote assignments
A typical day may include:
Providing practical and strategic legal advice and support on market access, market access strategy, government pricing, GPO account teams, and other Commercial-related matters in a fast-paced environment
Providing legal guidance on various Market Access and Commercial issues, tactics, and activities, including market access strategy development and materials, contract drafting and negotiation, government pricing, and interactions with healthcare providers, distributors, pharmacies, payers, PBMs, and GPOs.
Drafting and negotiating a wide variety of commercial contracts including distribution agreements, pharmacy agreements, rebate agreements, service agreements, managed care agreements, and other corporate agreements
Provide support to various Commercial teams and Product Attorneys on product-specific Market Access issues
Provide support to Corporate Compliance on Market Access issues
This role may be for you if you have:
Exceptional oral and written communication skills, including drafting skills, and presentation capabilities
Ability to maintain an independent and objective perspective while developing and maintaining a strong partnership with the client organizations
History of self-motivation, working independently on projects, meeting aggressive deadlines, and juggling multiple matters
Excellent understanding of healthcare laws and proven experience in applying them to complex business situation
To be considered for this role, we are looking for candidates with:
JD with 6+ years relevant legal experience
Licensed to practice law in New York or be eligible for licensure as a registered in-house counsel
Prior in-house healthcare/pharmaceutical and/or biotech experience required
Significant knowledge of life sciences regulatory enforcement trends, market access, market access strategy, government pricing requirements (ideally for both medical and pharmacy benefit products), market access contracts, contract operations, regulatory and compliance issues, the FDCA, the False Claims Act, federal and state fraud and abuse laws, and antitrust laws
